The application has been developed for educational purposes, namely, to encourage the public to separate waste correctly, thereby making the management and recycling of waste more economically feasible. 

By means of these terms and conditions, the company aims to achieve the following: 

• Lay out the rules of the game and how the prizes, if any, are won
• Explain to the user how personal data is processed and thereby comply with any the GDPR and other data privacy laws that may be applicable
• Limits its potential liability   

2.  Definitions

For the purposes of these Terms and Conditions: 

• Application means the software program provided by the Company downloaded by You on any electronic device, named Match the Bin! Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.
• Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Country means the Republic of Malta Company means WasteServ Company Limited having official registered address at ECOHIVE Complex, Tul il-Kosta Naxxar (NXR 9030), with registration number C-30560.
• Competition means the ECOHIVE: Match the Bin game within the Application.
• Device means any device that can access the Application such as a computer, a cell phone or a digital tablet.
• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Application.
• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Application.
• You means the individual accessing or using the Application, or the company, or other legal entity on behalf of which such individual is accessing or using the Application, as applicable.

3.  Use of Service

These are the Terms and Conditions governing the use of this Application and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Application. 

Your access to and use of the Application is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Application. 

By accessing or using the Application, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Application. 

Your access to and use of the Application is also conditioned on Your acceptance of and compliance with the Privacy Policies of the Company. The Company’s Privacy Policies describe the Company’s policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read the Company’s Privacy Policies carefully before using the Application. Apart from the Privacy Policy detailed in these Terms and Conditions, the other Company’s Privacy Policies can be accessible on the website http://www.wsm.com.mt 

4.  Participation

Participation is open to all individuals residing in Malta and Gozo, except for employees of WasteServ Malta Limited and their immediate family members. 

To participate, contestants must play the mobile app game: ECOHIVE – Match the Bin. 

Scores will be automatically recorded via the Application. Only scores submitted within the official competition period will be considered. 

The competition period will be between 17th June 2026 and closes on 31st August 2026.

5.  Links to Other Websites

The Application may contain links to third-party web sites or services that are not owned or controlled by the Company. 

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. 

The Company strongly advises You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit. 

6.  Termination

The Company may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Application will cease immediately.

7.  Limitation of Liability
Notwithstanding any damages that You might incur, the Company shall have no liability whatsoever from the damages caused by the software on the device You are using, even if such damages was carried out through gross negligence.

In no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Application, third-party software and/or third-party hardware used with the Application, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

8.  Country of Use
The software is intended to be used within the territory of the Republic of Malta. Should You use this software outside of the Republic of Malta, it is assumed that You will ensure compliance with all local laws and legislation.

9.  Applicable Law and Dispute Resolution

This agreement is governed by the laws of the Republic of Malta and any dispute which shall arise, even those relating to private international rules (a.k.a. conflicts of law) shall be governed by this Terms and Your use Application in accordance with the law of Malta which laws, excluding its conflicts of law rules, shall govern this Terms and Your use of the Application. Your use of the Application may also be subject to other local, state, national, or international laws.

If You have any concern or dispute about the Application, You agree to first try to resolve the dispute informally by contacting the Company. Should You wish to enforce any claim against the Company which claim arises over this Software, such claim may only be litigated in Malta and this subject to the exclusive jurisdiction of the Maltese courts.  

10.  Changes to These Terms and Conditions
The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, the Company will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at the Company’s sole discretion. 

By continuing to access or use the Company’s Application after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Application. The Company’s decisions in all matters relating to the competition is final and binding. 

11.  Awards 
This Application is for educational and environmental awareness raising purposes only. The Company, at its sole and complete discretion may give out prizes to any user it may deem fit, which award shall not only be based on the score but on any other factor the company may deem fit.  You may not use the game for the sole purpose of achieving the prize.

12.  Selection of Winners and Prize Claim Procedure

Each player will be eligible to win a prize from our lucky dip by showing proof that the app was downloaded and played on the device. Photos may be taken during the lucky dip for marketing and promotional purposes.

The top participant with the highest score at the end of each month will be eligible to win a prize. 

Winners will be contacted by email or phone using the details provided within the Application. Prize is to be collected physically from our Head Office at ECOHIVE Complex, Naxxar. 

It is the responsibility of the participant to ensure their contact details are accurate and up to date. 

Winners must reply to the Company’s notification email or phone within seven calendar days of being contacted. Failure to reply within the specified timeframe will result in forfeiture of the prize, and the prize will be awarded to the next eligible participant. 

The nature and details of the prizes will be communicated to the winners via email..  Prizes must be collected from our Head Office at ECOHIVE Complex. Naxxar. A photo of each winner may be taken at the time of prize collection for marketing and promotional purposes.

Prizes are non-transferable and non-exchangeable for cash or other alternatives. 

13.  Data privacy
By accessing and using the Application, participants consent to the collection and processing of their personal data for the purposes explained below.

The company may collect Your personal data that includes data which immediately identifies the individual, data which does not immediately identify the individual as well as contact details. Personal data shall be collected for statistical purposes, marketing purposes and providing award in previous section. The data in question shall be held by the Company and shall not be transferred to third parties unless required to do so by law. 

The Company’s Data Protection Officer is the person responsible to provide you with a copy of Your personal data or ensure that Your personal data is deleted upon request if the retention of the data is no longer required. While the company ensures that your personal data is securely stored it cannot guarantee against a data breach. Should there be a breach, you will be notified once the Company is notified about such a breach within a period of 5 working days. 14. Eligibility  

The Application is intended for use by individuals who are at least sixteen (16) years of age. By using the Application, You confirm that You meet this requirement. 

If You are under the age of eighteen (18), You confirm that You have obtained the consent of a parent or legal guardian to use the Application and participate in the Competition.     

15. Fair Use and Prohibited Conduct  
Users shall not:

• Use automated systems, bots, scripts or other tools to manipulate scores;
• Attempt to exploit bugs, errors or vulnerabilities within the Application;
• Create multiple accounts to gain unfair advantage;
• Tamper with the normal functioning of the Application.   

The Company reserves the right to disqualify any participant suspected of fraudulent or abusive behaviour at its sole discretion.     

16. Intellectual Property  
All content within the Application, including but not limited to text, graphics, logos, images and software, is the property of the Company or its licensors.   

You are granted a limited, non-exclusive, non-transferable licence to use the Application solely for personal, non-commercial purposes.   

You may not copy, modify, distribute or reverse engineer any part of the Application   

17. Security   
Users shall not attempt to gain unauthorised access to the Application, servers, or related systems.   

Any attempt to breach security measures may result in legal action and reporting to competent authorities.   

18. Force Majeure   

The Company shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, network failures, cyber incidents, or governmental actions.   

19. Modification or Cancellation of Competition   
The Company reserves the right to modify, suspend, or terminate the Competition at any time due to operational, legal, or technical reasons.   Any such changes will be communicated through the Application or official website.
