The Court of Appeal today annulled a Public Contracts Review Board decision which had endorsed WasteServ's procurement process for a new waste-to-energy plant, ruling that two PCRB members had a conflict of interest.
The court also concluded that one of the evaluators could not sit on the evaluation committee since the person was also a PCRB substitute member.
The court left it up to WasteServ to decide whether to further pursue the current procedure by appointing a new evaluation committee.
WasteServ will analyse the implications of this judgment to decide the best way forward.
